PERSONS ELIGIBLE TO ENTER
The Raffle is open to legal residents of San Diego County who are 18 years or older * with a valid driver's license, and FasTrak account in good-standing at the time of entry. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Employees of South Bay Expressway, herein referred to as SBX, its affiliates, subsidiaries, agents, advertising agencies, promotion agencies, consultants, advertising partners and contractors are ineligible. In addition, the parents, immediate family members or persons living in the same household of such individuals, are ineligible. Void where prohibited by law and all local laws pertain.
ONE ENTRY PER PERSON
Entrants may only enter once. Entrants may also only win once and shall be prohibited from winning any subsequent Sweepstakes from SBX for one year.
DEADLINE TO ENTER
The Sweepstakes begins at 12:00 a.m. midnight Pacific Standard Time (PST) on Thursday, October 15, 2009 and ends at 11:59 p.m. Pacific Standard Time (PST) on Thursday, November 5, 2009.
One (1) total prize will be awarded. Winner will be drawn from all official and eligible entries received between 12:00 a.m. midnight Pacific Standard Time (PST) on Thursday, October 15, 2009 and 11:59 p.m. Pacific Standard Time (PST) on Thursday, November 5, 2009.
HOW TO ENTER
NO PURCHASE IS NECESSARY AS A CONDITION OF ENTERING THIS SWEEPSTAKES. To enter, simply go to http://www.surveymonkey.com/s.aspx?sm=bNOE8cLOv5HdALSztM_2bD7Q_3d_3d and complete the survey. Enter the e-mail address associated with your FasTrak account in question number six (6).
SELECTION OF WINNER
One (1) prize winner will be selected. The winner will be randomly selected by a SBX representative on or about 10:00 a.m. on Friday, November 6, 2009 from a database containing the valid e-mail addresses submitted via the survey between 12:00 a.m. midnight Pacific Standard Time (PST) on Thursday, October 15, 2009 and 11:59 p.m. Pacific Standard Time (PST) on Thursday, November 5, 2009.
The winner will be notified on or about Friday, November 6, 2009 by telephone and if available, e-mail, based on their account information on file with SBX or the information provided on their FasTrak account. Entrants are responsible to ensure that their information is current. Winner will have forty-eight (48 hours) from notification to accept their prize by phone or email. SBX shall not be liable for unsuccessful efforts to notify a winner or winner’s unsuccessful attempts to contact SBX. If the winner for any reason fails to accept their prize within forty-eight (48) hours of notification, or if the winner chooses to decline his/her winnings, SBX may in its sole discretion, award the prize to another eligible winner.
The winner is required to prove eligibility. In case of any dispute as to the identity of a winner, the winner will be deemed to be the person who is the registered holder of the SBX FasTrak account associated with the survey taken.
Winner acknowledges that certain restrictions and requirements apply to this promotion. Failure to agree to, meet and/or abide by such restrictions and/or requirements may result in SBX awarding the prize to another eligible winner in its sole discretion.
ODDS OF WINNING
Odds of winning depend upon the number of surveys completed and valid e-mail addresses submitted between 12:00 a.m. midnight Pacific Standard Time (PST) on Thursday, October 15, 2009 and 11:59 p.m. Pacific Standard Time (PST) on Thursday, November 5, 2009.
PRIZES AWARDED
The raffle winner will receive twenty-five dollars ($25) in SBX TOLL CREDITS to be credited to their valid FasTrak account only.
All prizes are awarded "AS IS" and without warranty of any kind, express or implied, (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). All prizes will be awarded unless declined by the winner. No substitution, exchange or transfer of prizes or cash equivalent is permitted by the winner. SBX reserves the right to substitute a prize of equal or greater value.
WINNER'S RESPONSIBILITIES AND ENTITLEMENTS
The winner is solely responsible for all taxes, fees, surcharges and other costs on any prize received, including federal and state income taxes, and must furnish SBX with his/her social security number.
The winner will be required to complete a media release form and consents to the use of his/her name, address (city and state only), voice and/or photograph for commercial, advertising and promotional purposes without further compensation, unless prohibited by law.
South Bay Expressway $25 FREE TOLL CREDITS Restrictions and Details
Free toll credits are good only with a valid SBX FasTrak® account and will only be applied once a winner’s eligibility is verified. Winner’s free tolls will be credited to winner’s FasTrak account only.
Free toll credits must be used by May 30, 2010 after which, any remaining free toll credits will expire and be deducted from your prepaid toll balance.
Toll credits are good only for travel on SBX and only for transactions made with a valid SBX transponder read (“pay-by-plate” trips and trips using a transponder issued by another California toll operator are not included for payment by toll credits). Toll credits will be deducted from the account prior to any prepaid cash amounts. Tolls, fees and other charges for travel on any other California toll road that accepts FasTrak for which SBX has an interoperability agreement will be charged to the customer’s account separate of the SBX toll credits. Any deposits and/or account fees incurred by the customer (e.g., transponder deposit, lost transponder, etc.) will be charged to the customer’s account and paid against customer’s prepaid toll balance. Toll credits are not refundable or transferable and have no cash value.
Unless indicated otherwise, this promotion may not be combined with other SBX promotions. Where a conflict exists between promotions, SBX reserves the right to determine which promotion will apply.
All FasTrak terms and conditions apply. SBX reserves the right to modify, suspend, cancel or extend any promotion at any time without prior notice. SBX also reserves the right to change, add or delete to the official promotion details and restrictions at any time during any promotion, without prior notice.
RELEASE OF LIABILITY AND WAIVER OF CLAIMS AGAINST SOUTH BAY EXPRESSWAY
By being awarded the Prize, individuals release SBX and any of its respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "released Parties") from any liability whatsoever, and waive any and all causes of action related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with this Sweepstakes; or acceptance, use of, or inability to use, or participation in or inability to participate in the Sweepstakes; or use of, or inability to use any prize awarded as part of the Sweepstakes. This release includes, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to, or destruction of, property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, under a theory of contract, tort (including negligence), warranty or other theory.

To enter, tell us, in 150 words or less, the year, make and model along with what you named your "cool car" (if it had a name), and e-mail the information along with a great memory to coolcar@sbexpress.com. E-mails should be in word or .txt format. Please include full name and FasTrak account number in e-mail submission. Applicants can choose to write in to the contest. All entries must be original works, in English. Plagiarism, which includes the use of third-party poetry, song lyrics, characters or another person's universe, without written permission will result in disqualification. Excessive violence or sex, determined by the judges, will result in disqualification. Entries may not have been previously published in professional media. To be eligible, entries must be under 150 words. The Contest is open only to those who have not had professionally published a novel or short novel, or more than one novelette, or more than three short stories, in any medium.
By entering the contest, all entrants waive inspection or approval of the finished product or the manner in which it may be used, and hereby release South Bay Expressway , its employees, agents, and representative persons and entities from any liability. Entrants also hereby give South Bay Expressway the irrevocable right to publish and use your name, hometown, photograph, and story for advertising, trade promotions, or any other lawful purpose whatsoever.
